Do you need an Electrical Safety Inspection?

If you are a landlord renting out property to tenants, it’s essential to follow the latest guidelines around electrical safety. The Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020 became law in June 2020. They apply to all tenancies that started on or after June 1st 2020.

The new legislation means landlords need to have all electrical installations inspected at least every five years. These installations must be tested by a suitably qualified and competent person. Tenants must be provided with copies of electrical safety reports by their landlords. You may also need to provide copies to your local authority.

What to do next?

Once the inspection and testing have taken place, private landlords need to obtain reports from the people carrying out the work. The reports should include information on the results and the date of the next scheduled inspection and test. Landlords have 28 days to supply copies of reports to their tenants. If a local authority requires a copy of the report, you’ll need to get it to them within seven days of receiving the request. You must keep hold of your copy of the report until the next inspection and test. The person or people carrying out the subsequent inspection and test will also need a copy of the report. If a new tenant or tenants moves into the property, they will need access to the most recent report.

What to do if further work is required

If the report states that urgent work is required or that a ‘further investigation’ is needed, the private landlord needs to ensure the work is completed within 28 days or by the deadline mentioned in the report. This work must be carried out by a qualified, competent person. Once the work is complete, the landlord needs to source written confirmation that the work required is complete. Your tenants will also need access to this written confirmation as well as a copy of the report that said remedial or further investigative work was required. The local authority will also need this confirmation.
